Waste Collection Enfield Service Terms and Conditions

These Terms and Conditions set out the basis on which Waste Collection Enfield provides waste and rubbish collection services to domestic and commercial customers. By placing a booking or using our services you agree to be bound by these Terms and Conditions. Please read them carefully before confirming any service.

1. Definitions

In these Terms and Conditions, the following expressions have the meanings set out below:

Customer means the person, business, or organisation requesting or paying for the waste collection service.

Company means the waste collection service provider trading as Waste Collection Enfield.

Services means any waste, rubbish, junk, recycling, or related collection and removal services supplied by the Company to the Customer.

Booking means any confirmed request for Services made by the Customer and accepted by the Company, whether by telephone, email, online form, or in writing.

Waste means all materials, items, and substances presented for collection by the Customer as part of the Services.

2. Scope of Services

The Company provides scheduled and one-off waste collection and removal services, which may include household waste, bulky items, garden waste, commercial waste, and certain recyclable materials. The precise scope of the Services for each Booking will be confirmed at the time of booking, based on the description of the Waste provided by the Customer.

The Company reserves the right to refuse collection of any items that are hazardous, prohibited by law, or not accurately described at the time of booking, including but not limited to asbestos, clinical waste, certain chemicals, pressurised containers, and other materials deemed unsafe or inappropriate to handle.

3. Booking Process

3.1 A Booking may be made by telephone, email, or through an online request form, where available. The Customer must provide accurate information including their name, contact details, collection address, access details, and a clear description of the type and approximate volume or weight of the Waste to be collected.

3.2 The Company will provide an estimated price and proposed date and time for the collection based on the information supplied. A Booking is only confirmed when the Company accepts the request and provides written or verbal confirmation, and where applicable, after any required deposit or pre-payment has been received.

3.3 The Customer is responsible for ensuring that all details provided are complete and correct. If the information is inaccurate or incomplete, the Company may revise the quoted price, change the service schedule, or cancel the Booking.

3.4 Any changes to a Booking requested by the Customer must be communicated to the Company as soon as reasonably possible. The Company will use reasonable efforts to accommodate such changes but cannot guarantee availability or that the original price will remain unchanged.

4. Access and Customer Responsibilities

4.1 The Customer must ensure that the Company and its personnel have safe, timely, and reasonable access to the collection address and to the Waste to be removed at the agreed date and time.

4.2 Waste should be suitably prepared, bagged, or contained, and placed in an accessible location as agreed at the time of booking. The Customer must ensure that the Waste is not contaminated with prohibited or hazardous substances and that it is reasonably safe to handle.

4.3 Where the Company is required to collect Waste from inside a property, building, or restricted area, the Customer shall ensure that access routes are clear and safe and that the Company has the necessary permissions to enter the premises.

4.4 If suitable access is not available, or if the Waste is not presented as agreed, the Company may apply a waiting charge, a revised fee for additional labour or time, or may in some circumstances cancel the Booking and charge a failed collection fee.

5. Pricing and Payment

5.1 Prices for Services are based on factors including, but not limited to, the type of Waste, approximate volume or weight, labour required, access conditions, and any disposal or treatment costs. The Company will endeavour to provide a clear estimate in advance based on the information provided by the Customer.

5.2 Unless otherwise stated, prices are quoted in pounds sterling and may be subject to VAT where applicable under UK law.

5.3 The Company reserves the right to adjust the final charge if, on arrival, the volume, weight, type of Waste, or labour required differs materially from the description provided at the time of booking. In such cases, the Company will explain the difference and confirm any revised price before proceeding.

5.4 Payment terms will be confirmed at the time of booking. Unless agreed otherwise, payment is due on completion of the collection, or in some cases, in advance. The Company may accept payment by cash, debit or credit card, or bank transfer, subject to availability of payment methods and any applicable transaction requirements.

5.5 For business and commercial Customers, the Company may agree to provide Services on account, subject to a separate agreement or credit terms. Payment must be made by the due date shown on the invoice. The Company reserves the right to charge interest and reasonable recovery costs on late payments in accordance with applicable UK legislation.

6. Cancellations and Rescheduling

6.1 The Customer may cancel or request to reschedule a Booking by giving notice to the Company. Notice should be provided by telephone or email using the contact details provided at the time of booking.

6.2 If the Customer cancels more than 24 hours before the scheduled collection time, any pre-paid charges will normally be refunded, less any non-refundable costs incurred by the Company in preparation for the service.

6.3 If the Customer cancels less than 24 hours before the scheduled collection time, or fails to provide access when the Company attends, the Company reserves the right to charge a cancellation or failed collection fee to cover its costs, including staff time and transport.

6.4 The Company may, on rare occasions, need to cancel or reschedule a Booking due to circumstances beyond its reasonable control, such as severe weather, vehicle breakdown, staff illness, safety concerns, or regulatory issues. In such cases, the Company will use reasonable efforts to notify the Customer as soon as practicable and to agree a new collection date and time. The Company will not be liable for any loss arising from such cancellation or rescheduling, save for any refund of charges already paid for Services not provided.

7. Waste Regulations and Compliance

7.1 The Company operates in accordance with applicable UK waste management legislation and guidance, including, where relevant, requirements relating to waste carrier registration, duty of care, and proper disposal or recovery of waste at authorised facilities.

7.2 The Customer confirms that they have the right to authorise the removal of the Waste and that it does not include stolen goods, controlled substances, or any materials whose possession or disposal would be unlawful.

7.3 The Customer agrees not to conceal hazardous or prohibited items within general waste or other materials presented for collection. If such items are discovered, the Company may refuse to collect them, may adjust the price to reflect any additional handling, and may need to involve relevant authorities where required by law.

7.4 Upon collection, the Company assumes responsibility for the Waste and will transport it to licensed or authorised facilities for treatment, recycling, or disposal. The Customer acknowledges that once the Waste has been removed from the premises, they relinquish ownership and control over the Waste.

8. Liability and Limitations

8.1 The Company will exercise reasonable care and skill in providing the Services. However, the Company will not be liable for any loss, damage, cost, or expense that is not a reasonably foreseeable result of its breach of these Terms and Conditions or its negligence.

8.2 The Customer is responsible for protecting any fixtures, fittings, surfaces, or possessions that may be vulnerable to damage during removal and handling of Waste. While the Company will take reasonable care, it will not be liable for minor cosmetic damage or wear and tear arising from normal handling activities necessary to access and remove the Waste.

8.3 If the Company is found liable for any damage to property or possessions directly caused by its negligence, the Company may, at its option, repair the damage, replace the affected item, or pay fair compensation, subject to any applicable exclusions and to the overall limitation of liability set out below.

8.4 Nothing in these Terms and Conditions excludes or limits the Company’s liability for death or personal injury caused by its negligence, for fraud or fraudulent misrepresentation, or for any other matter which cannot lawfully be excluded or limited under UK law.

8.5 Subject to the preceding paragraph, the Company’s total aggregate liability to the Customer in respect of all claims arising out of or in connection with any single Booking or series of related Bookings shall not exceed the total amount paid or payable by the Customer for the relevant Services.

8.6 The Company shall not be liable for any indirect or consequential losses, including loss of profit, loss of business, loss of opportunity, or loss of goodwill, arising out of or in connection with the provision of the Services.

9. Customer Conduct and Health and Safety

9.1 The Customer shall behave respectfully and reasonably towards the Company’s staff and contractors. The Company reserves the right to withdraw its Services and cancel any Booking without liability where staff are subject to abusive, threatening, or unsafe behaviour.

9.2 The Customer must not request or insist that Company staff carry out any task that is unsafe, unlawful, or significantly outside the scope of the agreed Services. Staff have full discretion to refuse to undertake any activity they reasonably believe may present a risk to health, safety, or property.

10. Intellectual Property and Marketing

10.1 All content, branding, and materials used by the Company in connection with the Services remain the property of the Company or its licensors and may not be used without prior written consent.

10.2 The Company may refer in general terms to examples of work it has carried out, but will not publicly identify individual Customers without consent, except where required by law or regulation.

11. Data Protection and Privacy

11.1 The Company collects and processes personal information about Customers for the purpose of managing Bookings, delivering Services, processing payments, and complying with legal obligations.

11.2 The Company will take appropriate technical and organisational measures to protect personal data against unauthorised or unlawful processing and against accidental loss, destruction, or damage, in accordance with applicable UK data protection legislation.

11.3 The Customer has certain rights in relation to their personal data, including rights of access and correction, subject to legal conditions. Further details about how the Company handles personal data may be provided separately on request.

12. Complaints and Dispute Resolution

12.1 If the Customer is dissatisfied with any aspect of the Services, they should contact the Company as soon as possible, providing details of the issue and any relevant evidence.

12.2 The Company will investigate complaints in a fair and timely manner and will seek to resolve issues, where appropriate, by explaining what has happened, offering a remedy, or taking steps to prevent recurrence.

12.3 If a dispute cannot be resolved directly between the parties, either party may consider seeking advice from an independent body or legal representative. Nothing in this section affects the Customer’s statutory rights.

13. Amendments to These Terms

13.1 The Company may update or amend these Terms and Conditions from time to time to reflect changes in law, regulatory requirements, or its operational practices.

13.2 The version of the Terms and Conditions in force at the time the Booking is made will apply to that Booking, unless a variation is specifically agreed in writing between the Customer and the Company.

14. Governing Law and Jurisdiction

14.1 These Terms and Conditions, and any dispute or claim arising out of or in connection with them or their subject matter or formation, shall be governed by and construed in accordance with the laws of England and Wales.

14.2 The parties agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or their subject matter or formation, whether contractual or non-contractual.

By confirming a Booking or allowing the Company to commence the Services, the Customer confirms that they have read, understood, and agree to be bound by these Terms and Conditions.
